1. Acceptance of Terms
By accessing or using PomodoroTick ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to all of these terms, do not use the Service. We reserve the right to update these terms at any time; continued use after changes constitutes your acceptance.
2. Description of Service
PomodoroTick is a productivity application providing Pomodoro timers, task management, habit tracking, focus analytics, and related features. The Service is available via web browser at pomodorotick.com. Certain features require a paid subscription.
3. Account Registration
To access most features, you must register an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and accept responsibility for all activity under your account.
- Notify us immediately at hi@pomodorotick.com if you suspect unauthorised access to your account.
You may not create an account on behalf of another person without their permission, or use a false identity.
4. Free Trial
We offer a 7-day free trial of the paid plan. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue accessing premium features. Free plan features remain available indefinitely.
5. Subscriptions & Billing
Paid plans are billed on a monthly or annual basis, depending on the plan you select. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.
- Subscription fees are non-refundable except as described in our Refund Policy.
- You may cancel your subscription at any time; access continues until the end of the current billing period.
- We reserve the right to change pricing. You will be notified at least 30 days before any price change affects your subscription.
6. Intellectual Property
All content, design, code, trademarks, and materials comprising the Service are the property of PomodoroTick or its licensors and are protected by applicable intellectual property laws. You may not:
- Copy, reproduce, or distribute any part of the Service without written permission.
- Reverse engineer, decompile, or disassemble any part of the software.
- Use our name, logo, or branding without prior written consent.
Your data and content remain your property. By using the Service, you grant us a limited licence to store and process your data solely to provide the Service.
7. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations.
- Transmit harmful, abusive, or illegal content.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Use automated tools to scrape, crawl, or extract data from the Service.
- Interfere with or disrupt the integrity or performance of the Service.
8. Termination
We reserve the right to suspend or terminate your account immediately, without notice, if we reasonably believe you have violated these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases; we will handle your data in accordance with our Privacy Policy.
9. Disclaimers & Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not guarantee specific productivity outcomes from use of the Service.
10. Limitation of Liability
To the maximum extent permitted by law, PomodoroTick shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation first; if unresolved, through binding arbitration or courts of competent jurisdiction.
